Domestic Violence Victim Protection & Advocacy

It is an unfortunate fact that many spouses and partners are unaware that they are victims of domestic abuse. Domestic abuse can be physical, but it can also be emotional and financial.

Emotional abuse often goes undetected and unreported, and victims often do not get the protection that a well-designed divorce decree, paternity judgment or other court order can provide.

At the Law Office of Mei Nakamoto, our Honolulu attorneys provide legal advocacy and protection to victims of domestic violence. We can assist you by monitoring abusive tactics and advise you of your legal options, including obtaining protective orders.

Domestic Abuse And Temporary Restraining Orders

If your spouse or someone you are dating is abusing you in any way, consider getting information about your safety and your rights under the law. You may also seek a temporary restraining order (TRO) by first calling the Adult Client Services Branch of Family Court (ACSB) and providing details about the harassment or abuse, including any physical or psychological abuse, verbal threats, or property damage.

After the ACSB receives the information about the abuse and the alleged abuser, you will be scheduled for a family court appointment where you will file your TRO request with the judge for review.

Filing a TRO application with Hawaii's Family Court should not be taken lightly. The more detailed your application is, the better your chances are of getting a "stay-away" order without the abuser knowing about it until it is issued. Dates and specific descriptions of abuse can assist the court in making a decision that will protect you.

The TRO will result in a "stay-away" order and a date for you and the abuser to appear in court to tell your respective versions of what happened.

A family law and divorce attorney who is experienced in assisting victims of domestic abuse can help you with your TRO process, especially the court appearance, and provide guidance during this difficult time.
